Bosman Ruling

In football, Bosman ruling refers to the court declaration made by the European Court of Justice, allowing professional football players to freely transfer to another club within the European Union once their contract ends. The ruling was named after Jean-Marc Bosman, who challenge then football system by bringing his case to court. The result of this ruling changed how football players are employed.

How Bosman Ruling Came To Be

The term Bosman ruling was coined after Jean-Marc Bosman won the case by challenging the football system to court in 1990. While playing for the first division Belgian club, he wishes to transfer to Dunkerque, a French football club. However, the Belgian club wants the French club to pay the value fee of Bosman, amounting to £500,000, before granting the release. Unfortunately, the French club refuses to pay for the fee. It resulted in Bosman rejecting the offer, and his wages cut down to 75%.

Bosman protested the system and file a complaint against the Belgian Football Association and the European Football Association (UEFA), alleging infringement of freedom. He argued that his rights were violated due to the rules mandated by UEFA. He further stated that the rules prevented him from leaving the Belgian club even though his contract has ended.

In 1995, the European Court of Justice released a court decision enabling members to transfer openly to another team after their contract is finished. The ruling also includes that the clubs can hire as many players within the European Union.

The changes brought on by Bosman ruling creates a significant impact on the football players. It also granted the players freedom when it comes to their terms of the contract.
